Information obligation for the Company's contractors and clients
1. Your personal data will be processed by the Administrator for the following purposes and on the basis of the following legal provisions:
a. performance of the contract - to the extent necessary to perform the contract (Article 6(1)(b) of the GDPR) - for the duration of the contract;
b. settling the performance of the contract between the parties, including making payments - to the extent necessary to perform the contract (Article 6(1b) of the GDPR) - for the duration of the contract;
c. fulfillment of obligations in the field of enforcement of claims - in order to fulfill obligations in the field of enforcement of receivables arising from the Code of Civil Procedure, the Act on Enforcement Proceedings in Administration, the Act on Court Bailiffs (Article 6(1)(C) of the GDPR) - for a period consistent with the provisions of generally applicable law;
d. fulfillment of obligations in the field of accounting - in order to fulfill the obligations arising from the Accounting Act (Article 6(1)(C) of the GDPR) - for 5 years from the end of the year in which the event occurred;
e. fulfillment of tax obligations - in order to fulfill obligations arising from tax regulations, in particular the Tax Ordinance, the Corporate Income Tax Act, the Goods and Services Tax Act (Article 6(1)(C) of the GDPR) - for 5 years from the end of the tax year;
f. fulfillment of obligations arising from the Accounting Act and tax obligations (Article 6(1)(c) of the GDPR) – for 5 years from the end of the tax year;
g. pursuing claims or protection against claims - in order to implement the legal legitimate interest of the administrator consisting in asserting its property or non-property rights, or protection against claims against the administrator, in accordance with general provisions, in particular the Civil Code (Article 6(1)(a) f GDPR) – for 3 years from the occurrence of damage that is causally related to the event causing it + 1 year
2. The recipients of personal data may be entities providing services on behalf of and on behalf of the administrator, such as: a company providing ICT services such as hosting, entities providing legal and advisory services, postal operators, as well as those entities to which the administrator is obliged to provide data under applicable legal provisions, such as the tax office, courts, other state authorities.
3. The Administrator may process the following personal data: NIP, REGON, address of residence/registered office of the business and other data related to the business, if necessary, personal data indicated in the documentation, including certificates confirming specialist qualifications held and contact details, i.e. telephone number, e-mail address. In the case of employees of contractors and persons designated to handle contracts, it will process data such as: name, surname, contact details (telephone, e-mail, business address), position.
4. Providing data is voluntary, but failure to provide it will result in the inability to conclude a contract.
5. The Administrator's contractors and clients have the right to access the data, the right to rectify the data, the right to receive a copy of the data, the right to delete data, the right to limit data processing, the right to transfer data, and the right to raise an objection.
